ESTATE PLANNING and PROBATEA person who has passed away without having created a valid will prior to his/her death is said to be intestate. If a person dies without a will in Texas, the laws of intestacy governs the disposition of Decedent’s estate rather than the wishes of the Decedent. The effect of intestacy is further complicated by the potential delays that may occur due to the necessity to determine the rightful heirs of Decedent’s estate. Moreover, the appointment of an administrator may be required to settle the estate, which sometimes requires the posting of a bond.
There are three types of wills that are recognized in Texas. The first type is the attested will (also known as a formal will) that is normally drafted by a legal professional. To create an attested written will, it must be executed by the testator, witnessed by two credible witnesses above the age 14 years, and the witnesses must sign the will in the presence of the testator (person creating the will). If the will is made self-proved, then it may be admitted to probate without the testimony of any subscribing witness. The second type is called the holographic will which is written wholly in the handwriting of the testator. The third type is an oral will which is valid only if made during the testator’s last illness while at home or if taken away from home and passes away before returning home. The disposition of property of an oral will only applies to personal property, and if the value of the personal property exceeds $30, there must be three or more credible witnesses to the oral will. There are some exceptions and/or additional requirements that must be met in order for a will to be probated. A court will uphold a will only if it is valid, thus it is crucial to retain the service of an attorney experienced in will drafting so that the requirements of the formation and execution of the will are followed so that Decedent’s last wishes are effectuated. ASSET PROTECTIONTax avoidance vs tax evasion. Tax evasion is the intentional avoidance of tax by inaccurately declaring taxable income. Tax evasion is a crime, while tax avoidance is implementing legal methods to achieve minimal impacts of taxation, divorce, and/or bankruptcy.

GUN TRUSTSSimply, it’s a revocable living trust (RLT) specifically written to own guns. Trusts are commonly used for estate planning and a properly drafted gun trust provides you with a trust that is specifically written for firearms with detailed instructions on how trust assets will be used and for whom. An invalid/non-compliant trust risks firearm confiscation or even a charge of an “accidental” felony. This can occur when you innocently “share” regulated Nation Firearms Act (NFA) firearms with your family or friends. Penalties are severe – up to ten years in prison and fines up to $250,000 or more, for conviction under the National Firearms Act.

Generally, when a taxpayer is confronted with an IRS problem, the taxpayer may be facing issues such as an IRS audit, levy, liens, seizures, wage garnishment, or payroll tax issues.
